Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "you") and Vantage 360 Tours ("we", "us", "Company"). By accessing or using our platform at vantage360tours.com, you confirm you are at least 13 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Vantage 360 Tours is a web-based platform that allows users to:

• Upload equirectangular panoramic images
• Build interactive virtual tours with hotspots and navigation panels
• Publish and share tours via unique URLs hosted on Cloudflare's infrastructure

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

3. Account Registration

You must create an account to use the service. You agree to:

• Provide accurate and complete information during registration
• Keep your password secure and confidential
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that contain false information or that violate these Terms.

4. Subscriptions & Payments

4.1 Plans and Pricing

We offer Free, Basic ($10/mo), Standard ($20/mo), and Pro ($50/mo) plans as described on our Pricing page. Plan features and limits are subject to change with 30 days' notice to existing subscribers.

4.2 Billing

Paid plans are billed monthly in advance. Payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis until you cancel.

4.3 Free Plan Limitations

Free plan tours remain published for 3 days from the date of deployment, after which the live URL becomes inactive. Your tour data in the editor is not deleted.

4.4 Cancellation

You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date. See our Refund Policy for refund eligibility.

4.5 Extra Tours

Basic and Standard plans support purchasing additional tour slots at $1/mo per slot. These are billed alongside your base subscription and cancelled with it.

5. Your Content & Licence

5.1 Ownership

You retain all intellectual property rights in the content you upload (panoramic images, tour configurations, branding assets). We do not claim ownership of your content.

5.2 Licence to Us

By uploading content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and serve that content solely for the purpose of providing the service to you.

5.3 Your Responsibility

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not infringe any third-party intellectual property, privacy, or other rights.

6. Acceptable Use

You agree not to use Vantage 360 Tours to:

• Upload, publish, or share content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Infringe any intellectual property rights of any party
• Upload malware, viruses, or any malicious code
• Attempt to gain unauthorised access to our systems or other users' accounts
• Scrape, crawl, or systematically extract data from the platform without permission
• Use the service for any unlawful purpose or in violation of any applicable laws

We reserve the right to remove content and terminate accounts that violate these rules.

7. Intellectual Property

The Vantage 360 Tours platform, including its software, design, branding, and documentation, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without our express written permission.

8. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination:

• Your published tours will be taken offline
• Your account data will be deleted within 30 days (payment records retained as required by law)
• Accrued payment obligations remain due

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Vantage 360 Tours shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Vantage 360 Tours and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes will be resolved in the courts of competent jurisdiction in the United States.

13. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the platform. Continued use after changes are effective constitutes acceptance.
